1. Introduction
This Privacy Policy describes how Cooper Delivered Digital (Cooper Delivered Digital, we, us or our) collects, holds, uses, discloses and otherwise manages personal information in connection with our websites, applications, software, plugins, digital products, development services and related business activities.
We are based in Western Australia, Australia.
We are committed to handling personal information responsibly and transparently and have prepared this Privacy Policy having regard to applicable Australian privacy requirements, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), where applicable.
By accessing or using our websites, purchasing our products or services, creating an account, submitting information through our forms or otherwise dealing with us, you acknowledge the practices described in this Privacy Policy.
2. Scope of this Privacy Policy
This Privacy Policy applies to personal information handled by Cooper Delivered Digital through or in connection with:
the Cooper Delivered Digital website;
our WooCommerce store;
Cooper Delivered Earth;
The Board;
Ground Zero;
Cooper Delivered Digital WordPress and WooCommerce plugins;
website development and other digital development services;
our Digital Shelf and downloadable products;
support and technical enquiries;
partnership, licensing, sponsorship and commercial enquiries;
email communications; and
other digital products or services operated by Cooper Delivered Digital from time to time.
Certain products may also contain additional privacy notices dealing specifically with the functionality of that product.
Where an additional privacy notice applies, it should be read together with this Privacy Policy.
3. What is personal information?
For the purposes of this Privacy Policy, personal information generally means information or an opinion about an identified individual, or an individual who is reasonably identifiable.
The information we collect depends upon how you interact with us.
We seek to limit collection to information reasonably required for the relevant purpose.
4. Personal information we may collect
Depending on your interaction with Cooper Delivered Digital, we may collect or hold information including:
your name;
email address;
telephone number;
billing and delivery address;
business or organisation name;
website address;
account and login information;
order and transaction information;
licence information;
correspondence with us;
information submitted through enquiry, application or support forms;
project briefs and information supplied in connection with website or digital development work;

6. Information you enter into our applications
Our applications and digital tools are designed to allow users to enter information for their own purposes.
Depending upon the product, this may include garden records, plants, seeds, tasks, journal entries, photographs, marketing plans, campaign information, content ideas, business information, notes and other user-generated material.
You are responsible for determining what information you choose to enter into our products.
You must not enter personal information about another person unless you have the right or authority to do so.
We recommend that users do not enter unnecessary sensitive, confidential or highly identifying information into fields that do not require it.
7. Cooper Delivered Earth
Cooper Delivered Earth uses account functionality to associate a user’s garden information with that user’s account.
Information associated with an Earth account may include:
email address;
account credentials;
garden plans;
seed information;
plant information;
garden tasks;
journal entries;
planting records; and
photographs voluntarily uploaded or captured by the user.
Earth is not designed as a public social network. Information within an individual user’s garden account is not intended to be publicly visible to other Earth users.
Users may delete their account using available account functionality, subject to any information we are lawfully required or reasonably entitled to retain.
8. The Board
The Board uses account functionality to provide users with a private marketing-planning workspace.
Information voluntarily entered into The Board may include campaigns, marketing plans, content ideas, marketing pillars, research, investigation notes, shoot plans, marketing funnels, business goals, journal entries, tasks, photographs and other business or marketing information.
The Board is a planning and organisational tool and is not intended to operate as a public social network.
9. Ground Zero
Ground Zero is designed to minimise the collection of identifying information.
The current Ground Zero experience allows a user to answer a structured series of questions and receive generated guidance without requiring the user to provide their name or email address solely to complete that experience.
Certain information may be retained on or associated with the user’s device or browser as required for functionality.
Future versions of Ground Zero may introduce additional functionality. Where that functionality materially changes the personal information collected or how that information is handled, this Privacy Policy or an applicable product-specific privacy notice may be updated.
Ground Zero outputs constitute guidance only and are subject to the applicable Terms of Use and disclaimers.
10. Payments and financial information
Payments for products and services may be processed using third-party payment processors, including WooPayments, Stripe, PayPal and Square.
Payment-card and financial information required to process a transaction is provided to and processed by the applicable third-party payment provider.
Cooper Delivered Digital does not intentionally store complete payment-card numbers, CVV/security codes or online banking credentials within its own systems.
We may receive and retain transaction information reasonably required for order administration, accounting, refunds, disputes and customer support.
Payment providers operate under their own privacy policies, security arrangements and terms.
11. WooCommerce
Our ecommerce functionality is operated using WooCommerce.
WooCommerce may process information necessary to operate our online store, including information relating to accounts, shopping carts, checkout, orders, licences, downloads and customer transactions.
Information generated through a purchase may be retained where reasonably required for fulfilment, customer support, accounting, taxation, fraud prevention, dispute resolution and other legitimate business or legal purposes.
12. Analytics and technical information
We use Google Analytics and may use other technical tools to understand how our websites and digital services are accessed and used.
These technologies may process information such as device type, browser type, operating system, approximate geographic information, referring website, pages viewed, session and interaction information, date and time of access and other technical information.
We use this information to understand website performance, improve user experience, identify technical problems and understand how our digital services are being used.
13. Cookies and similar technologies
Our websites may use cookies and similar technologies necessary for website functionality, ecommerce, security, authentication, preferences, analytics and performance.
Some cookies are necessary for services such as account sessions, shopping carts and checkout functionality.
Browser settings may allow you to reject or delete certain cookies. Disabling necessary cookies may prevent some website functions from operating correctly.
14. How we use personal information
We may collect, hold and use personal information for purposes including providing our products and services, administering accounts, processing purchases, delivering digital products, administering licences, providing support, investigating bugs, responding to enquiries, assessing development projects, managing partnerships, processing refunds, maintaining security, preventing fraud, maintaining business records and complying with legal obligations.

15. Disclosure to service providers
We may disclose or make personal information available to third-party service providers where reasonably required to operate our business.
These may include providers of web hosting, ecommerce infrastructure, payment processing, email services, analytics, data storage, backups, cybersecurity, fraud prevention, software infrastructure, app distribution and professional services.
Our current technology environment includes services supplied by organisations such as VentraIP, WooCommerce, Google, Stripe, PayPal and Square.
We do not disclose personal information to third parties merely because they wish to market their products or services to our users.
16. Sale of personal information
We do not sell personal information.
We do not operate a data-broker business and do not sell customer databases or identifiable user information to unrelated third parties for their independent marketing purposes.
17. Hosting and storage
Our website infrastructure is hosted using services provided by VentraIP Australia.
Information may also be processed or stored through other technology providers used in connection with our website, applications, ecommerce systems, analytics, communications, backups or payment processing.
We take reasonable steps appropriate to the nature of our operations to protect personal information held or controlled by us.
18. Overseas processing and disclosure
Some third-party technology providers used by Cooper Delivered Digital operate internationally or use infrastructure located outside Australia.
Accordingly, personal information may in some circumstances be processed, accessed or stored outside Australia.
This may particularly arise through internationally operated payment, analytics, email, cloud or technology services.
Where Australian privacy law imposes requirements concerning overseas disclosure of personal information, we will seek to comply with those requirements where applicable.
19. Gmail and electronic communications
We use Google services, including Gmail, for business communications.
If you email us or we correspond with you by email, information contained in those communications may therefore be processed through Google’s services.
Please do not send passwords, complete payment-card information or other unnecessary sensitive information by email.
20. Marketing communications
Where you subscribe to or consent to receive marketing communications from us, we may use your contact information for that purpose.
Where required by applicable law, marketing communications will provide a means of unsubscribing.
Unsubscribing from marketing communications does not necessarily prevent us from sending transactional or operational communications reasonably required in connection with an account, purchase, licence, service or support request.
21. Security
We take reasonable administrative, technical and organisational measures appropriate to our operations to protect information against loss, misuse, interference and unauthorised access, modification or disclosure.
However, no internet transmission, website, application, server, database or electronic storage method can be guaranteed to be completely secure.
Accordingly, we cannot warrant or guarantee absolute security.
Users are responsible for maintaining the confidentiality of their account credentials and for securing devices through which they access our products.
22. Data breaches
Where we become aware of unauthorised access to, disclosure of, or loss of information, we may investigate the circumstances and take reasonable remedial action.
Where applicable law requires notification of an eligible data breach to affected individuals or a regulator, we will take reasonable steps to comply with those requirements.
23. Retention and deletion
We retain personal information only for so long as reasonably necessary for the purpose for which it was collected, for legitimate business purposes, or as required or permitted by law.
Retention periods may vary depending upon the nature of the information.
For example, transaction and accounting records may need to be retained after an account or customer relationship ends.
Where information is no longer reasonably required, we may delete, destroy or de-identify it, subject to applicable legal and technical requirements.
24. Access and correction
You may contact us to request access to personal information we hold about you or to request correction of information that is inaccurate, out of date, incomplete, irrelevant or misleading.
We may need to verify your identity before providing access to personal information or making certain changes.
There may be circumstances in which access or correction may lawfully be refused or limited.
Where applicable, we will deal with requests in accordance with Australian privacy requirements.
25. Account deletion
Where a Cooper Delivered Digital product provides account-deletion functionality, users may use that functionality to request or initiate deletion of their account.
Deletion of an account does not necessarily require deletion of every record associated with that account.
We may retain information where reasonably necessary or required for financial and taxation records, fraud prevention, security, dispute resolution, enforcement of legal rights, backups and compliance with applicable law.
26. Third-party websites and services
Our websites, applications and digital products may contain links to third-party websites, platforms or services.
We are not responsible for the privacy practices, content, security or operation of independent third parties.
Users should review the privacy policies and terms of third-party services before providing information to them.
27. Children’s privacy
Our commercial websites, software and digital services are not primarily directed at children and we do not knowingly seek to collect unnecessary personal information from children.
If we develop a product specifically directed at children or young people, we may implement additional privacy notices, consent processes or safeguards appropriate to that product.
28. Privacy enquiries, access requests and complaints
Privacy enquiries, access or correction requests and complaints concerning the handling of personal information should initially be directed to Cooper Delivered Digital through our Contact page.
Please provide sufficient information for us to understand and investigate your request.
We may request additional information where reasonably necessary to verify your identity or investigate the matter.
We will endeavour to acknowledge and deal with privacy complaints within a reasonable period.
Where the Privacy Act applies and you are not satisfied with our response, you may have the right to make a complaint to the Office of the Australian Information Commissioner (OAIC).
29. Changes to this Privacy Policy
We may amend this Privacy Policy from time to time, including where our products or services change, new functionality is introduced, our technology providers change, our information-handling practices change or applicable laws or regulatory guidance change.
The current version will be published on this page.
The effective or last-updated date appearing at the beginning of this Privacy Policy indicates when it was most recently revised.
